2.8. Royal assent

 

 

Even when passed by both Houses of the legislature, the constitution of Australia requires that legislation be approved by the head of state. This 'Royal assent' is given by the Queen's representative. Is this merely a formality, or can the Crown reject or alter bills that the legislature has approved? Choose the best answer from those below.

(a) The Crown has a theoretical power to reject legislation passed by the legislature. But, by convention, Royal assent is always given to legislation that has been enacted.

(b) The Crown has no constitutional power to reject legislation passed by the legislature. Royal assent is no more than an historical formality..

 (c) The Crown cannot reject legislation passed by the legislature, but the Queen's representative can make changes to the provisions in the bill before giving Royal assent.
