2.2. Which government will legislate?

 

 

To implement this policy, legislation must be enacted making it a criminal offence to cause injuries during sporting contests in specified circumstances.

But more than one government in Australia has the power to enact legislation, and the powers they have are not all the same. Which of the statements below is correct?

(a) Only the federal (Commonwealth) government has the constitutional power to enact legislation on matters such as this.

(b) Both the federal (Commonwealth) government and the state or territory governments have the constitutional power to enact legislation on  matters such as this.
