5. Protection against unfair business practices

5.1. Prohibition of unfair practices

 

 

 

Over the years, the suppliers of goods and services have invented ways of carrying on business that, for a variety of reasons, have proven to be less than totally honest or fair.

The provisions of Chapter 3, Part 3-1 of the Australian Consumer Law (ACL) identifies these unfair practices and prohibits them.  Important questions that arise are:

  • Which practices are prohibited as unfair practices?
  • How are these provisions enforced?
