Joe Ovadia has raised three interpretation questions in his defence against a charge under s 4 of the Injuries in Sports Act 2012 (Vic).
- Do the provisions of the Act extend to cases where the injury was not inflicted intentionally?
- What is meant by the word 'injury' as used in the Act?
- Can a prosecution under s 4 take place even if the relevant sports authority has already taken disciplinary action?
Relevant rules of statutory interpretation, as explained in the previous section of this module, must be applied to answer these questions.
