7.2. The relevance of intention  

 

 

Is it a good defence to argue that Joe acted instinctively and did not intend to injure Eric? This depends on what s 4 of the Injuries in Sports Act requires. Read the Act and then choose the best answer from those below.

(a) The Act says nothing about intention and the unqualified words 'cause injury' in s 4 make it irrelevant that Joe acted instinctively rather than deliberately or carelessly.

 

(b) The Act says nothing about intention, but the words 'cause injury' in s 4 must be interpreted in a way that distinguishes between instinctive acts and those that are deliberate or careless.
