3.  Terms implied into contracts for the sale of goods

3.1 Filling gaps in the agreed terms of a sale contract

 

 

 

In the event that there are gaps in the agreed terms of a contract of sale, the sale of goods legislation provides for the following important matters:

  • The identity of goods goods bought and sold
  • Delivery of goods goods bought and sold
  • Payment for goods goods bought and sold
  • A buyer's legal title to goods bought and sold
  • Inspection of goods delivered to a buyer
  • The quality of goods bought and sold

Although the same provisions exist in all the state and territory sale of goods legislation, the section numbers differ. The equivalent numbers of selected sections is shown in the table below.
