2.  Sale of goods legislation in Australia

2.1. The origins of Australian sale of goods legislation

The law of sale that applies in Australia today was initially developed in England, over many years, by judges deciding disputes that came before the courts.  Then, in 1893, the English Sale of Goods Act was compiled. It consolidated the principles that the courts had laid down, in a concise but comprehensive code.

The current Australian state and territory sale of goods legislation are all copies, with small amendments, of this original Sale of Goods Act 1893 (UK).

The acts which make up the Australian sale of goods legislation are  shown in the table below.

NSW Sale of Goods Act 1923 Vic Goods Act 1958
Qld Sale of Goods Act 1896 WA Sale of Goods Act 1895
SA Sale of Goods Act 1895 ACT Sale of Goods Act 1954
Tas Sale of Goods Act 1896 NT Sale of Goods Act 1972
