11.4. Identifing the issue that arises from the facts

 

 

 After establishing the material facts of the case, it is necessary to identify and clearly state what is in dispute between the parties. What exactly are the parties arguing about?   What question, arising from the facts, must be decided to resolve the dispute?  Consider the following list of possible questions.  Which one of them best states the the nature and extent of the dispute (issue) that arises in the current example?
