3. Express and implied agreement to terms

3.1. Different ways of 'agreeing' to terms

 

 

 

There are many different ways in which the parties can incorporate particular terms into their contract. One way is to reach agreement on what is being promised.

Reaching agreement on particular terms involves:

  • an exchange of information about the terms in question and
  • a signal of assent to those terms.

These things can come about in circumstances that may be more or less obvious.  It is important to be able to recognise them.
