Liability in tort for wrongful conduct

1. The role of tort law

1.4. The aim of this module

The aim of this module is to provide an introduction to the structure and scope of tort law. This is done by presenting many different situations where liability in tort might arise. With each example there are questions that get you to think about how the law classifies and deals with each type of situation.

If you have already studied some tort law, you may know the answers to the questions, but otherwise the feedback will tell you what you need to know.

Take your time with the examples. Analyse them carefully and try to identify the important differences between them. You will quickly learn to distinguish one type of tortious conduct from another. You will also learn what basic legal concepts are applied in each case, when a right to compensation is likely to exist, and what limits the law places on such rights. This introduction will give you a useful basis for further study of more detailed materials.

On the next page, there is an table of the various torts recognised in Australian law, with brief explanations describing each tort. This table gives a useful overview of liability in tort for wrongful conduct.
