2.3.4. Property rights in things brought by a tenant onto leased premises

 

 

 

Albert will need to bring his own equipment and machinery onto the property he might lease. Some of these things will need to be fitted and installed in the building. He wants to know if this will affect his ownership of those things. Consider the following statements and choose the one that is correct. 

(a) Any thing brought onto leased premises by the tenant remains the property of the tenant, even if that thing is fixed or attached to the property. The tenant therefore has the right to detach and remove such things at the end of the lease.

(b) Any thing brought onto leased premises by the tenant remains the property of the tenant unless that thing is fixed or attached to the property, in which case it may become the property of the landlord. A tenant may not have the right to detach and remove such property at the end of the lease.
