5. Breach of a duty of care

5.1.1. The obligation to prevent harm to the plaintiff 

 

 

 

A duty of care gives rise to a legal obligation requiring a defendant to prevent wrongful harm to the plaintiff.  But to what extent is a defendant required to act to prevent such harm?  We can begin by answering this question in broad terms. Which is the best of the answers below? 

(a) In broad terms, the obligation created by a duty of care requires a defendant to do whatever is necessary to prevent any harm to the plaintiff from occurring.

(b) In broad terms, the obligation created by a duty of care requires a defendant to take reasonable steps to prevent foreseeable harm to the plaintiff from occurring.
