11.2. Four things to remember

As a starting point, recall some of the things that have been discussed in this module:

• To achieve proper outcomes, cases need to be distinguished on their material facts and similar cases should be decided the same way.
• The legal question (the issue) that arises from particular facts needs to be identified and clearly stated.
• The relevant law must be found, explained and then applied to the facts.
• Conclusions should be drawn deductively and must be consistent with decisions in previous similar cases.
