Statutory provisions affecting contracts for goods and services

5. The Australian Consumer Law

5.11. Guarantees with regard to the supply of services

All the examples so far in this section have dealt with guarantees in relation to the supply of goods to a consumer.

The provisions of s 60 - 63 of the ACL provide similar guarantees with regard to the supply of services to a consumer. This means that, if the relevant transaction if for the supply of services rather than goods, there are guarantees that:

  • services will be supplied within a reasonable time.
  • services will be rendered with due care and skill
  • services will be reasonably fit for the purposes made known to the supplier by the consumer

These guarantees cannot be excluded by contract.
