6. Enforcement of statutory guarantees

6.1. Enforcement and remedies

 

 

 

There are various remedies available for a breach of a provision of Chapter 3 of the ACL. These remedies include injunctions; damages; compensation orders; non-punitive orders; and other orders, such as declaring a transaction void.

Chapter 5, Part 5-4 of the ACL sets out additional remedies available to a consumer for breach of a statutory guarantee. The available remedies depend on the nature of the failure to comply. A distinction is drawn between:

A failure to comply that can be remedied and is not a major failure

A failure to comply that cannot be remedied or is a major failure
