7.2. Enforcement and remedies

 

 

 

A failure to comply with safety standards, or the supply of banned goods, or a failure to comply with a recall notice, or a failure to give notice of a death, injury or illness, or to comply with information standards may be punished by a civil pecuniary penalty.

Such conduct is also made a criminal offence, punishable by a fine.

General remedies are also available for contraventions the provisions of Chapter 3 of the ACL (injunctions; damages; compensation orders; non-punitive orders; and other orders).

In addition to other remedies and penalties, a person who supplies goods which have been recalled is made liable for harm caused to another person because of the breach.
