3.5.6. Loan for use without payment

 

 

 

One of Albert's employees is moving house, and Albert agrees to lend one of his vans to the employee for a weekend so that he can transport his goods. Albert tells the employee that he does not want any payment for the use of the van.

In these circumstances, which of the following statements is correct?

(a) When one person lends his chattels to another and permits the borrower to use them, and no payment is required, the borrower is not liable for either wear and tear, or for any harm caused to the chattels.

(b) When one person lends his chattels to another and permits the borrower to use them, and no payment is required, the borrower is not liable for wear and tear but will be liable for harm caused by their negligence to the chattels.
