2.2. Private ownership of land

2.2.1. Finding out who is the legal owner of property

Review the facts of the case study. The first option being considered by Albert is to purchase the land that is for sale, to acquire ownership. With this in mind, he wants to make sure that the seller is the legal owner of the property.

Consider the following statements and choose the one that is correct.

(a) In Australia, the private ownership of all land is registered and the titleholder of land can be ascertained by consulting a register. There is no unregistered title to land.

(b) In Australia, the private ownership of most land is registered and the titleholder of registered land can be ascertained by consulting a register. However, the ownership of some land is not registered and ownership of such land is proved by documents showing the 'chain of title'.
