7.2.  The right to enforce a contractual obligation

 

 

 

Read the facts and the question and then choose the best answer.

A says: "I agreed to cut the grass in B's garden each week for three months in exchange for a one-off payment of $300. B paid me but I have not cut the grass as promised."

B says: "A agreed to cut the grass in my garden and has not done so. However he is my friend and I don't want to enforce the agreement."

C says: "I live in same house as B. I want the grass cut and I want to enforce the agreement and make A do what he promised."

Can C enforce the agreement and make A cut the grass?

 

(a) Yes. C can enforce the agreement because she is a person who gets a benefit from it.

(b) No. C cannot enforce the agreement because A made no promises to C.
