Making a contract
6. Capacity to contract

6.6. Other circumstances involving limited contractual capacity

There are various other circumstances in which a person's capacity to contract may be limited or restricted.

In particular, a person who is insolvent has a restricted capacity to enter into contracts.

A person under the influence of intoxicating drugs may also be sufficiently unaware of what they are doing to bind themselves contractually.
