You should note that, in addition to the general law of unconscionable dealing that has been explained in this section, the Australian Consumer Law (ACL) now prohibits what is called 'unconscionable conduct' in trade or commerce.
The statutory provisions of the ACL exist alongside the general law of unconscionable dealing and there is considerable overlap between them.
