First Principles of Business Law

Circumstances that may invalidate a legal transaction

4. Unconscionable dealing

4.4. Statutory Unconscionable Conduct

You should note that, in addition to the general law of unconscionable dealing that has been explained in this section, the Australian Consumer Law (ACL) now prohibits what is called 'unconscionable conduct' in trade or commerce.

The statutory provisions of the ACL exist alongside the general law of unconscionable dealing and there is considerable overlap between them.

The provisions of the ACL are explained in the module 'The regulation of undesirable business practices'.
