11.3 Revocation and renunciation

 

 

 

Read the facts below, which are the same as in the last question, and then answer the questions.

A owns a house which she wishes to sell. She appoints B as her agent, to find a buyer for the house. The agency agreement is in writing and one of the terms is that the period of the agency is for six weeks from the date of signing the agreement. A and B sign the agreement on June 1. 

1. If, before the end of the agreed period, A decides that she no longer wishes to sell the house, and wants to put an end to B's agency, can she withdraw B's authority to represent her?

2. If B wants to be guaranteed against the possibility of A terminating the agency before the expiry of the six week period, can the appointment be made effectively irrevocable by agreement between A and B that it should be so?
