(a) Common law remedies are available for a breach of a condition in a contract, whereas equitable remedies are available for a breach of a warranty in a contract.
(b) Common law remedies are the ‘normal’ remedies for breach of contract, whereas equitable remedies are available only at the discretion of the court in particular circumstances.
(c) Common law remedies for breach of contract cannot be excluded or modified by agreement between the contracting parties, whereas equitable remedies can.
