Case study: The electrician

Question 8.

Assuming Miles succeeds in establishing that Peter is liable for Negligence, how would the court quantify the damages which Miles has suffered?

(a) Damages would be calculated to include both the cost of repairs to the factory and the lost profits.

(b) Damages would be calculated to include only the cost of repairs to the factory but not the lost profits.

(c) Damages will be awarded only to the extent that the damaged building is worth less than it was before the fire, rather than by taking account of what it would cost to repair it. The lost profits could also be claimed.
