Non-compensatory damages.

Non-compensatory damages of various kinds can be awarded against a defendant. Such damages are not intended to compensate for harm suffered, but to establish some principle or point.

  • Nominal damages merely signal that the defendant has committed a breach of a legal duty, although no harm has been suffered.
  • Exemplary, contemptuous and aggravated damages are awarded as a mark of the court’s disapproval of particular conduct.
