Mitigation of loss

To 'mitigate' means to lessen, minimise, reduce or diminish.

In contract law, when a breach of contract happens, the non-defaulting party is required to take reasonable steps to mitigate the loss that they suffer as a result of the breach. The non defaulting party will not be allowed to claim damages for loss that they could themselves have avoided by taking reasonable steps to mitigate that loss.
