The word 'contract' is used to describe the agreement

The courts will not necessarily decide that the words used by the parties truly reflect what they intended. Sometimes people use legal words carelessly, without regard for their technical meaning.

However it may be that, combined with other factors, the use of terms such as 'contract', 'right', 'duty' or 'obligation' will be held to signify an intention to be legally bound by an agreement.
