An Act may have a section that indicates when it becomes operational. This is known as a ‘commencement’ section. Always check to see if there is a commencement section.
If there is no commencement section in an Act, remember that there are rules particular to each legislature regarding when the Act will begin to operate – for instance Commonwealth Acts without a commencement provision come into effect 28 days after receiving Royal assent.
