Sections 131 and 132 of the ACL require a supplier of goods or services who becomes aware of the death, serious injury or illness of a person that may have been caused by the use of consumer goods or services must make a report to the Commonwealth Minister responsible for the administration of the Competition and Consumer Act 2010 (Cth), identifying the goods or services and other relevant circumstances.
This notice does not amount to an admission of liability for the harm, but enables the Minister to take appropriate action, e.g. by recalling or banning the goods or services.
