(a) Anticipatory breach of contract occurs when a contracting party has indicated by words or conduct that they do not intend to perform the contract, either at all or as agreed, when performance is due.
(b) An anticipatory breach gives the non-defaulting party an immediate right to relief, even before performance is due.
(c) Anticipatory breach of contract allows further performance of the contract to be terminated but does not allow the non-defaulting party to claim damages.
