(a)  In addition to terms that become part of a contract by agreement, terms can be made part of the contract by operation of law, even if the parties were unaware of such terms at the time of contracting.

(b)  In contract law, agreement to particular terms can be implied when, although the terms are not put into words, it can be inferred from the circumstances that the parties intended to agree to the suggested terms.

(c)   In contract law, a 'representation' is a statement made when a contract is being negotiated, in circumstances from which it can be inferred that the parties intended that what was said should be legally enforceable.
