Quiz: The contents of a contract

Question 7

A drives his car into a parking garage. He takes a ticket from the machine at the entrance gate on his way in.  The words ‘Conditions of entry apply’ are printed on the front of the ticket.  The words: Cars parked at owner’s risk’ appear on the back of the ticket.  A does not read the writing on the ticket before going through the gate and parking.  In the light of these facts, which of the following statements is correct?

(a)  A has not agreed to park his car at his own risk because a ticket does not obviously contain contractual terms and he did not have his attention sufficiently drawn to what was written on the ticket.

(b)  A has agreed to park his car at his own risk because, on the given facts, he appears to have agreed to the terms that were printed on the ticket when he entered the garage and parked there.

(c)   By the time that A could have read the ticket and discovered the terms printed on the reverse side, the contract between A and the owner of the parking garage was already made and it was too late to put the risk on A.
