(a)  If legislation and case-law provide conflicting rules, then the legislative provisions will be given effect by the courts.

(b)  When the meaning of legislation needs to be decided, it is the courts that have the responsibility of deciding what the legislation means.

(c)   When a court is of the opinion that the effect of applying legislation will be unfair or harsh, the court can disapprove the legislation and decide the case in a different way.
