Breach of a duty of care

In the tort of Negligence, a breach of a duty of care occurs when a wrongdoer fails to do what ought to have been done to prevent foreseeable harm from occurring. The extent to which action needs to be taken to prevent foreseeable harm depends on various factors, such as the seriousness and likelihood of the harm, and how difficult it would be to prevent it.
