Duty of care

In the tort of Negligence, a 'duty of care' is a duty to prevent foreseeable harm to another person. It arises when harm to another person is considered to be foreseeable by the wrongdoer, and when, in the circumstances, the wrongdoer and the person likely to be harmed have a sufficient relationship to give rise to a duty of care.
