The tort of Negligence consists of a person failing to do what should have been done in the circumstances to prevent foreseeable harm to another person or their property.
Liability for Negligence arises whenever it can be shown that a duty of care existed between the wrongdoer and the person harmed; that the duty of care was breached; and that the harm was caused by that breach.
