3. (a) That's not correct. Assault is a species of trespass (trespass to the person), and torts of trespass do not require that actual damage be proved. It is the mere threat of making imminent unlawful contact that is actionable, allowing the plaintiff to claim an appropriate remedy.

But note that compensatory damages will only be awarded if the plaintiff suffers actual harm as the result of the assault.
