3. (b) That's correct. If the property in question was not damaged or destroyed, the plaintiff cannot claim substantial damages because there is no harm to compensate for. In such cases a court would either make a declaration of rights, or award purely nominal damages. The plaintiff could also seek an injunction to prevent a recurrence of the trespass.

If the property is damaged or destroyed, the plaintiff can claim damages to compensate for the loss.
