Assuming that a court found that Tyler's advertisements were likely to mislead the public, would Paul himself be liable for a breach of s 18 of the Australian Consumer Law?

(a) Yes, even an agent can be liable for such conduct if they have participated in the events, whether or not they intended to mislead.

(b) No. Paul was acting as an agent for Tyler. Agents are only a representative of their principal and do not themselves acquire any legal liability when acting as an agent.

(c) No. Although an agent can be liable for such conduct, they will only be held liable if it can be shown that they had the intention to mislead.
