These costs are recoverable. Funeral expenses are recoverable in all jurisdictions. These expenses are the one exception to the general concern of the survival of actions legislation which is to allow the recovery of losses incurred before the victim's death.
Except in Victoria and Queensland, funeral expenses are also recoverable by the deceased's dependants under the dependants' action.
