A's lost future earning capacity

These losses cannot be recovered. The legislation specifically excludes recovery of damages for the future probable earnings of the deceased. The survival of actions legislation only makes provision for the estate of the deceased to recover losses incurred after the accident and prior to death. It does not provide for compensation for future losses.

However, the loss of future earnings may be claimed by dependants of the deceased (as distinct from the estate of the deceased).
