Breach of an innominate term in a contract. 

Termination is available for a breach of an innominate (intermediate) term provided that the breach substantially deprives the plaintiff of an intended benefit of the contract. 

However, if a breach of an innominate term does not have the effect of substantially depriving the plaintiff of an intended benefit of the contract, the breach does not justify terminating performance.
