It is wrong to say that the phrase ‘common law’ is properly used to refer to those laws that are commonly found to exist in the legal systems of all modern states.  In Australia, the phrase ‘common law’ is used to refer to the law that was developed and applied throughout England to replace local laws.

While it is true to say that the phrase ‘indigenous law’ can be used to refer to laws developed within a particular country, it is not true to say that, because Australia has inherited English law, it has no indigenous law.  Aboriginal Australians developed indigenous laws long before the introduction of English law, and much of it survives alongside English law.

It is correct to say that the word ‘custom’ is properly used to refer to rules of conduct established by long tradition and obeyed because of peer pressure or convenience.
