(a)  The parties to a contract are not entitled to obstruct the other parties’ performance but are not required by law to do anything that actively assists the other party to perform.

(b)  If a contracting party requires other parties to cooperate with them in the performance of their contract, they must include an agreed term setting out the details of what is required.

(c)   Even if there is no agreed term in a contract that requires the parties to cooperate in the performance of the contract, Australian law makes a general duty to cooperate a term of every contract.
