Defaulting / non-defaulting party

The term 'defaulting party' is used to describe a party to a contract who is in breach of their obligations, e.g. because of a failure to perform as promised.

The term 'non-defaulting party' (or 'aggrieved party') is used to describe the other party, who alleges a breach of contract and wishes to enforce their legal rights under the contract against the defaulting party.
