1 (a) That's not right. The facts given do not suggest that the accident could be explained by any particular facts known to the court. Of course, if such facts are proved, there is no room for 'res ipsa loquitur'.

 But in the absence of any such facts being proved, the plaintiff may be entitled to rely on the principle, as long as the other elements are satisfied.
