Terms implied by legislation

In addition to terms that become part of a contract by agreement, terms can be made part of the contract by law, including legislation. 

The sale of goods legislation is one example of legislation that puts terms into contracts, to fill gaps in the agreed terms.

If a term is put into a contract by law, including legislation, it creates obligations and becomes enforceable in the same way as agreed terms.
