(a) That's wrong. The key facts in this example are that A bought goods by description (i.e. by reference to a description of them as belonging to a particular class or kind of goods) from B who is a dealer in such goods. In these circumstances, s 56 of the ACL provides a guarantee that the goods supplied will accord with the description under which they were sold.

The facts show that the machine was described as 'a Simpson Front Loader washing machine as advertised'. The description therefore includes the specifications listed in the catalogue. It is clear that the machine that has been delivered does not accord with these specifications.

The available remedies for breach of a statutory guarantee are explained at the end of this section.
