A 'representation' is a statement of fact, made when a contract is being negotiated, but which is not intended by the parties to become a binding promise. In the absence of any such intention, a representation does not become a term of the contract.
The existence of the relevant intention is decided by drawing the appropriate objective inference from the observable facts at the time the statement is made.
